Planque Membership Terms & Conditions
The most up to date version of these Terms &
Conditions will be available to reference in the Account section of your
Members Login.
1. Your Membership Application
By completing and submitting your application for
membership, you agree to be bound by the clubhouse rules.
You are free to withdraw your application at any time before
it is accepted by us. Should you wish to do so, please contact our membership
team at members@planque.co.uk. Applications are reviewed monthly and new
members are admitted if space is available. Planque has sole discretion as to
who shall become a member.
Planque will confirm acceptance of your membership
application once payment has been taken by sending a 'Welcome to Planque’
confirmation email to the email address provided on your application.
Your membership will commence at the beginning of the month
for those who have opted for an annual subscription fee and can be started
mid-month for those who have opted for a monthly subscription fee, unless you
have made alternative arrangements with the Planque Management Team.
Planque reserves the right to charge members a joining fee,
an annual subscription fee, or a monthly subscription fee and for admission to
the clubhouse premises from time to time. The right to amend or waive any such
fees or subscriptions from time to time shall be in Planque’s sole discretion.
2. Membership Renewal
Membership is for a minimum six-month commitment period from
the date your membership commences for those members who pay their subscription
fees on a monthly basis. Following the initial six-month period, your Planque
membership will renew on a rolling monthly basis thereafter until either of us
terminates it in accordance with these terms.
Membership is for a minimum twelve-month commitment period
from the date your membership commences for those members on an annual
subscription and your subscription will automatically renew unless you inform
us otherwise.
For Gift memberships, the minimum term for those who pay
their subscription fees on a monthly basis is a six-month commitment and for
the annual membership a twelve-month commitment. Gift memberships will not
automatically be renewed, and a renewal notice will be sent to either the
benefactor or recipient dependent on what was specified on the original
application by the benefactor.
3. Your Personal Information
It is important for us to have your current details as well
as a recent photograph of you in our membership database. By becoming a member
of Planque, you agree that we may hold your personal details and photograph to
use in connection with your membership. If any of your personal details change,
please let us know as soon as possible by emailing members@planque.co.uk or you
can make the changes through your Member Login.
We take protection of your personal information seriously
and will process it in accordance with our Privacy Policy. Please ensure you
read the policy and are happy with it before submitting your membership
application or personal data to us.
4. Membership Payment
Membership rates are made up of a one-time joining fee and a
monthly or annual subscription fee. Our current prices are reflected in our
latest membership brochure available on our website.
The joining fee and first month’s fee will become payable
upon approval of your membership application by us. The full monthly membership
fee for subsequent months will become payable by the first of each month for
the duration of your membership.
For those members who pay an annual subscription fee, the
joining fee and annual fee will become payable upon approval of your membership
application by us.
By providing us with your payment details, you agree to
being charged the joining fee upon your application being approved and being
charged the applicable monthly fee for a minimum of six months by continuous
credit or debit card every month until your membership ends.
For those members who pay an annual subscription fee, you
agree to being charged the joining fee upon your application being approved and
the one-off annual subscription fee by continuous credit or debit card.
It is within our sole discretion to amend our membership
fees at any time, including the amount, date, or frequency of the payment of
your membership fees. If we do so we will notify you at least 30 days in
advance. The minimum term for those on a monthly membership would still be six
months with at least 30 days' notice by email thereafter.
Additional products and services such as retail purchases
and event tickets will be charged to your account at the time of purchase.
Additional charges incurred in the clubhouse at Planque can be charged to your
account at your discretion or paid for at the time of dining.
Any additional charges incurred to your membership account
will be billed monthly and automatically charged to your payment details on
file. This may include reservation fees, packaging or delivery fees, or cellar
overages.
Failure to pay any part of the membership fees within one
month of the due date will result in the member not being admitted to the
property and the membership being terminated. We will notify you by email if
your membership is terminated.
5. Cancellation of Your Membership
If you need to cancel your membership, please let us know by
emailing members@planque.co.uk. Please do so from the email account you used to
set up your membership so we can be certain that it is you who wants to
terminate.
Members can terminate your membership on a calendar months'
notice (expiring on the last day of a calendar month after the month in which
notice is served) without reason, subject to the sixmonth minimum initial term.
If you want to cancel your membership during the initial six-month period, the
joining fee and full six-monthly fees shall be payable by you and
non-refundable. In such circumstances, we would take the remainder of the
monthly fees for the initial period by continuous credit card or debit card as
a lump sum. You would still be able to use the property and facilities for the
initial term provided you have paid this lump sum in full. After the initial
sixmonth period, you can terminate at any time by giving us at least one
calendar months’ notice by email.
Members who pay annually can also cancel their membership
within these same terms but will not receive a refund for any membership dues
for membership remaining. If we materially breach these terms, you can
terminate your membership immediately on notice to us.
We can terminate your membership by giving at least one
calendar months' notice to you without reason (expiring only after the initial
six-month period), or immediately on notice to you if you materially breach
these terms (including but not limited to where we specifically state a breach
will result in a right to terminate).
Where termination is by one calendar months' notice, notice
must be served by the final day of the month prior to the month you wish to
terminate.
Where we have a right to terminate under these terms, we may
choose to suspend your membership instead. If your membership is suspended,
your monthly fee is still payable and there will not be any refund, but you can
terminate your membership in accordance with the above.
Where termination or suspension of your membership is
immediate due to breach, you will not be entitled to enter Planque's premises
or use our facilities during such suspension or following such termination.
The Planque management may, at its absolute discretion,
waive or reduce the subscription fee of any member or former member. In the
event of a former member of Planque applying to rejoin the club we may choose
to waive the joining fee.
Members must collect wine from their Planque cellar on or
before their termination date. If members do not collect their wine on or
before their termination date, Planque has the right to charge the member a
monthly cellar storage fee.
6. Membership Benefits
Membership benefits apply only to the member named at the
time of application. Benefits are non-transferable and guests may not use
benefits in the place of the member, including accessing cellared wines. The
rights of the member cannot be assigned without the written consent of Planque.
It is within Planque’s sole discretion to amend or
restructure our membership offering at any time. If we do so we will notify you
at least one calendar month in advance so you have the opportunity to cancel
your membership if you do not agree to the changes. The minimum term for those
on a monthly membership would still be six months with at least one calendar
months’ notice by email thereafter.
7. Gift Memberships
A recipient of a Gift Membership receives all the same
benefits as a Planque member, and the terms and conditions of membership are
the same.
8. Guests
Members are welcome to bring up to six guests to join them
in the members’ lounge and to accompany them to members-only events. Please
email members@planque.co.uk if you would like to arrange for more guests to
join you in the members’ lounge. Please be aware, however, that during very
busy times we may have to restrict member/guest access to certain areas. Members
may bring up to twelve guests to dine in La Cachette.
Members must ensure their guests follow all Planque rules
and policies or may face suspension or termination of their membership if their
guests violate such rules or policies.
9. Member Cancellation and No-Show Policy in the
Restaurant
We require credit card details for all reservations to
protect against no-shows and late cancellations. Members must give Planque at
least 24 hours’ notice if you need to cancel or reschedule your reservation to
avoid a fee of £50 per guest at dinner or £45 per guest at lunch. For
reservations of seven guests or more, we require at least 72 hours’ notice. To

10. Children
Planque does not offer membership to anyone under 18. Guests
under the age of 18 are welcome in the restaurant but are not permitted in the
members’ lounge.
If you are bringing children, we ask that you respect other
people's space and motives for being at Planque. You are solely responsible for
any children that you bring to the property. Any guest under the age of 16
should be accompanied by an adult.
11. Phones, Laptops, Cameras
To protect the relaxed atmosphere within the clubhouse, we
would like to avoid the use of these types of technology as much as possible.
Please respect the privacy of other members and their guests whilst at the
clubhouse. Do not take photos or videos of our guests without asking their
permission first.
12. Confidentiality
Planque management and all staff members are required to
adhere to the strictest confidentiality standards and pledge to process all
personal information of the members and their guests in accordance with our
privacy policy.
13. Illegal Substances & Items
No member or guest shall purchase, use, ingest, possess,
sell, or otherwise distribute illegal drugs or other substances, or attempt to
do any of the same with any member or guest. No member or guest shall ask any
Planque staff for illegal drugs or other substances while on clubhouse
premises, or in the immediate vicinity thereof. If any of the actions above
prove true, the relevant member and/or guest will be removed from the clubhouse
and the membership in question will be terminated.
No member or guest shall purchase, sell, use, or possess any
object which is illegal or offensive while on clubhouse premises or in the
immediate vicinity thereof. If any such objects are found, the item will be
confiscated, the relevant member and/or guest will be removed from the
clubhouse, the membership in question will be terminated and, depending on the
circumstances, we may have to call the police or relevant authorities.
14. Membership Card & Bills
To use members only spaces at Planque you will need to show
your membership card.
Members must settle all bills before leaving Planque.
Members are responsible for their guests' bills if they are not paid. Members
with unpaid bills will not be allowed to use Planque's facilities until these
bills are settled. You should not give or lend your membership card to anyone
else
such as a guest or non-member. They won't be able to use it;
you'll get a telling off and would be responsible for any costs they incurred.
Membership numbers are non-transferable and will not carry
over if the membership is cancelled for any period of time.
15. Entering & Leaving
We like our neighbours, and we ask all members and guests to
respect our nearby residents by being quiet when entering or leaving the
premises or while in the surrounding areas.
16. Dogs & Animals
We are dog friendly. Members will be responsible for always
supervising their dog and will be solely responsible for their dog's behaviour
and wellbeing. Members are responsible for stopping them from making a mess,
damaging property, wandering in prohibited places, and disturbing other members
and guests.
17. Disciplinary Procedure
Every member must abide by the rules and regulations of
Planque at all times upon acceptance as a member. If Planque considers that any
member’s conduct either inside or outside of the clubhouse premises is, at its
absolute discretion, contrary to the interests of Planque.
Planque may with immediate effect expel the member or guest
from the clubhouse premises and/or suspend or terminate that member’s
membership without having to give any reason to such member or guest.
Conduct by a member or guest that is prejudicial to the
reputation and character of Planque may result in suspension or expulsion of
such member or guest. Such conduct may include inappropriate, violent, or
abusive behaviour, or the communication of information concerning the clubhouse
affairs, members or their guests in the clubhouse to the media. An expelled
member may not return to any clubhouse as a guest. A refund of the expelled
member’s subscription will be at the discretion of Planque. Any member or
members who wilfully remove, damage, or destroy any property belonging to the
clubhouse, or to members or guests on the premises of the clubhouse, will be
liable to expulsion and/or suspension or termination of their membership.
18. Private Hire, Closure, and Maintenance
We reserve the right to close Planque to all members and
guests with fair notice for private events which require the property to be
closed to members and guests, or for other planned closures of the business.
Planque will be closed for two weeks of planned closure each year, where the
property will be unavailable to members. We will give members notice for any
planned closures of the entire property.
We are not able to guarantee that all facilities will be
available all of the time. We may need to close Planque without notice for
emergency maintenance or repair, for health or medical reasons, on government
guidance or for legal reasons but will endeavour to give advanced notice where
practical to do so. Where we have done so, we will seek to ensure that access
to Planque is reinstated as soon as practicable. We may need to withdraw
facilities or services because we consider that they may pose a risk to the
health or safety of our members, guests, or staff, or that they are detrimental
to the business.
19. Planque Events
Paid-for events will not be refunded if cancelled with less
than 48 hours' notice of the scheduled start time of the event. Any
cancellations submitted with less than 48 hours' notice will not be refunded.
You can email members@planque.co.uk or access your Member Login to manage your
event bookings.
We may film or photograph events which take place at
Planque. If you take part in these events, you acknowledge that we may use your
name, image, and other limited information in promotion of the events and
Planque. You consent to us publishing any materials produced by or for us, for
any purpose without your further consent. You also waive any right to receive
any payment from us in connection with such publication.
20. Accidents & Injuries
If you are involved in or witness an accident or injury,
please let us know as soon as possible, and at least within 24 hours of it
happening. This is primarily so we can ensure you and anyone else involved are
ok, but also so we can comply with our health and safety obligations and for
insurance purposes. Any medical personal data collected in relation to an
incident will be kept secure and processed in accordance with our privacy
policy.
21. Liability
Nothing in these terms should be taken to exclude or limit
in any way our liability to you where it would be unlawful to do so. This
includes liability for death or personal injury caused by our negligence or the
negligence of our employees, agents, or subcontractors, for fraud or fraudulent
misrepresentation, or breach of your statutory rights. The rest of this clause
and the terms should be understood subject to this.
We are responsible to you for foreseeable loss and damage
caused by us. If we fail to comply with these terms, we are responsible for
loss or damage you suffer that is a foreseeable result of our breaking this
contract or our failing to use reasonable care and skill, but we are not
responsible for any loss or damage that is not foreseeable. Loss or damage is
foreseeable if either it is obvious that it will happen or if, at the time the
contract was made, both we and you knew it might happen, for example, if you
discussed it with us during the sales process.
We are not liable for business losses. Memberships are for
private use only and not for any commercial gain. If you use Planque for any
commercial, business or re-sale purpose we will have no liability to you for
any loss of profit, loss of business, business interruption, or loss of
business opportunity.
Items brought to Planque, and left there or left unattended,
are done so at the risk of a member and their guests. Planque, its staff and
contractors, are not liable to any member or guest for any loss, damage or
injury suffered by them or their property (except where specifically excluded
or limited in this clause above).
Subject to the above sections of this clause, our maximum
liability to any member shall be the amount of membership fees (joining fee and
monthly fee) they have paid to us.
22. CCTV
Planque uses CCTV cameras and operates them in accordance
with all relevant legislation. No images will be provided to third parties for
commercial, entertainment or any other purposes. CCTV images may be used for
verifying compliance with these terms, to resolve any dispute to identify
individuals involved in wrongdoing or anything illegal.
23. Smoking Policy
All members and their guests must adhere by Planque's
smoking policy and to all applicable smoking related laws, rules, and
regulations. No smoking (including e- cigarettes and vapes) is allowed inside
the clubhouse at any time. Planque reserves the right to designate certain
outside areas as smoking areas and to change the location of such areas at any
time however, all members and their guests are requested to respect the wishes
of other members and their guests with respect to smoking and to refrain from
smoking when requested to do so.
24. Our Trademark Rights
Members and their guests shall not use the names, logos,
colours, trademarks, service marks, photographs, trade dress, or other
identifying features of Planque and its affiliates without obtaining the
specific prior written approval.
Members and their guests may not produce, use, or create, or
authorise others to produce, use or create, the Planque Marks for any purpose
whatsoever, including, but not limited to, in any communications, marketing,
advertising or other promotional materials (including, but not limited to,
brochures, flyers, invitations, e-mail messages, etc.) without Planque's prior
written consent.
25. Amendments to the Rules
Planque may change the rules from time to time, by
displaying notification of the change in your Members Login. Please be aware
that the rules in your membership package may not be
completely up to date and that the latest version of the
rules are displayed online in your Members Login.
26. Interpretation of the Rules
We reserve the right to make reasonable changes to these
Terms and Conditions from time to time. When we do so see the amended Terms and
Conditions can be viewed in your Member Login.
27. Complaints & Disputes
If you have any questions or complaints about Planque or
your membership, please contact us by email at members@planque.co.uk.
Alternatively, please speak to a member of our team in person at the clubhouse.
If there is any confusion or dispute around the
interpretation of these terms or any other rules of the property, the matter
shall be referred to Planque's Management, whose decision with respect to your
membership shall be final and without appeal.
28. Outside Food & Beverage
Due to health and safety protocols, outside food of any kind
is not permitted, unless medically
necessary. Beverages can be brought from outside by members
and/ or their guests, in addition to drinking wines accessed by a member from
their Planque cellar. 29. Rights & Privileges of Membership
A member shall be entitled to all the rights and privileges
of the clubhouse granted to a person in his, her or their capacity as a member
and shall be bound by these rules but shall have no proprietary rights in any
of the premises or in respect of property of the clubhouse.
While we encourage community and engaging with other members
within the clubhouse, we ask that all members and their guests be respectful of
one another and their privacy. Use your best judgement.
30. Acceptance of Wines
Wines will only be accepted by Planque for storage at our
facilities under the following conditions. Planque shall not be bound by any
variation to these conditions unless the variation is in writing, signed on
behalf of Planque by its duly authorised officer. All goods shall be stored and
carried by Planque at the members risk in all things.
31. Members’ Assurances
It is required that the member confirm that wines are fully,
adequately, and truly described on all deposit notifications at the time of
receipt. The member should make their own inquiries as to the suitability and
fitness of Planque for their purposes and have not relied upon any
representations made by Planque.
The member must be the owner of the wines deposited to
Planque or will otherwise lawfully be entitled to store the wines at Planque.
Wines must not be subject to any encumbrance or right of any third party which
would or might prevent the member storing them at Planque on these conditions
during any period of storage.
All customs, excise, duties, and tax will be paid in full in
relation to wines before they are deposited with Planque for storage and
Planque shall not be liable for any failure to pay taxes in relation to wines.
The member indemnifies Planque against any claim, action,
damage, loss, liability, cost or expense which Planque incurs or is liable for
in connection with: Any damage, loss, injury or death of any person caused or
contributed to by the member; any damage to the property of Planque or third
parties caused or contributed to by the member; any default by the member under
these conditions; and any breach by the member of the warranties set out.
32. Insurance
Planque shall maintain an industrial special risks insurance
policy in respect to the wines stored within Planque. Unless otherwise agreed
in writing, all wines stored within the Planque cellar will be automatically
included under this policy.
Bottles are insured up to £30 per bottle, members may elect
to arrange additional insurance for anything exceeding this amount. Members who
elect to arrange their own insurance must provide Planque with written
confirmation of this and a current certificate of currency on request.
Wines are not insured unless all storage and insurance
invoices have been paid in full by their due date.
33. Access to the Cellar
A member shall have no right to enter the secure area of the
cellar without Planque’s consent and then only in accordance with the access
and security procedures published by Planque.
Withdrawal requests for members from the Planque cellar are
the following.
• Tuesday to Friday: Book your wine out up to 2pm on that
day.
• Saturday lunchtime: Please give us notice by Friday 2pm.
• Saturday evening: Book your wine out up to 2pm on that
day.
Members on occasion will be able to access their wines
during restaurant service for a corkage fee of £20 per bottle. This may not
always be possible if we have busy restaurant service or if there is a ticketed
guest chef event.
34. Member Corkage Allowance
Members and their guests can bring wine in for a corkage fee
of £20 per bottle and there is no limit to the number of bottles members can
bring in from outside. The £20 corkage fee is applicable to both unopened and
opened bottles and food must be ordered to accompany the wine. There is no
charge for corkage when a member drinks wine from their Planque cellar.
35. Cellar Inventory Records
Planque will maintain an ongoing record of wines held in the
cellar by members. Planque will provide members with a copy of these records
via the cellar inventory software.
The member indemnifies Planque against any claim, action,
damage, loss, liability, cost, or expense for typographical, data entry, or
cataloguing errors made within the cellar inventory records.
36. Security & Inspection of Wines
Subject to these conditions and to any express or implied
instructions by the member to the contrary from time to time, all Cases stored
within Planque will be opened and the wines checked by Planque for their
suitability of storage.
Despite anything contained in the preceding condition, where
circumstances require, in the exercise of its absolute discretion, Planque
shall be entitled to open any sealed Case in which wines are placed and peruse
any document accompanying or associated with wines to determine the nature,
condition, or ownership of the wines.
37. Dangerous Goods
If, in Planque’s opinion, wines are or are liable to become
dangerous goods, Planque may at any time destroy, dispose of, abandon, or
render the wines harmless without liability or compensation to the member and
without prejudice to Planque's right to any charges under these terms.
38. Repacking of Wines
If wine cartons are damaged or otherwise require replacement
from time to time, Planque may, in the exercise of its absolute discretion,
repackage wines in new cartons at the member’s expense.
39. Storage, Delivery & Collection of Wines
Storage fees for a maximum of 36 bottles, or three cases, of
wine are included in the price of Planque membership. Please note that wines
stored at Planque must be fully duty paid, as we are not a bonded warehouse.
Wines stored at Planque will count towards inventory on the
following scale based on volume:
100cl or less = 1 bottle |
101cl-299cl = 2 bottles |
300cl or more = 4 bottles |
Members can inform Planque of a delivery of wine to store in
their member cellar either by a wine merchant, courier, or a drop off in person
by submitting the Cellar Delivery Form which must be filled out in advance.
Alternatively, members can send over their wine merchant’s delivery notice. The
Cellar Delivery Form can be found in the Member Login portal, in the cellar
section.
The preferable times for delivery or drop off are Tuesday to
Friday, 10.00am to 5.00pm or on a Saturday afternoon, from 12pm to 5pm.
Planque retains absolute discretion to at any time refuse
the transport or carriage of wines for any person or the transport or carriage
of any class of wines or any particular wines.
Despite any specific instructions given by the member as to
the mode of carriage of goods, in Planque retains absolute discretion to carry
wines or have them carried by sub-contractors and by any means.
Delivery charges shall be considered earned whether or not
wines are delivered to any nominated consignee and whether damaged or
otherwise, i.e., if a consignee named in the member's delivery instructions is
not in attendance at the address specified or if Planque arrives to effect
delivery at a consignee's premises and for any reason outside Planque's control
Planque is delayed in effecting prompt delivery.
Planque will be entitled to charge the member an additional
charge for every call made for delivery purposes or for the time.
40. Limitation of Liability
Planque shall not be liable for any loss or damage to the
wines arising out of their packing, storage, or handling, whether in transit or
otherwise.
To the full extent allowed by law, Planque shall not be
liable in any way to any person for and is expressly released by the member
from any liability for: any loss, deterioration, contamination or evaporation
of or any damage to goods while in Planque's possession or control; any failure
to deliver wines at a time or to a place specified by the member or at all; and
any consequential
loss suffered by any person arising out of any of these
matters even if the alleged liability arises out of Planque’s negligence or any
breach of contract by Planque.
To the full extent allowed by law, any conditions or
warranties which are imposed or implied by any Law in relation to the storage
or carriage of wines which are adverse to Planque are hereby excluded and to
the extent that they cannot be excluded, then Planque obligations shall be
limited to the supply of its services again or payment for the supply of those
services.
If by operation of law, Planque is held liable in any way to
any person Planque's liability shall be limited to £250 per case in total in
respect of the whole of the member's wines irrespective of the number of
individual cases stored by Planque or the actual value of the wines.
41. Lien
Planque shall have a lien on all wines and any documents
relating to them for all sums payable by the member to Planque and for that
purpose Planque shall have the right to sell wines by public auction or private
treaty on giving not less than 14 days’ notice to the member.
42. Governing Law & Jurisdiction
These Terms and Conditions shall be governed and construed
in accordance with English law and each member agrees to submit to the
exclusive jurisdiction of the courts of England. This is without prejudice to
your rights to bring a claim in your local court.
